Terms of Service

1. Who We Are

FendLand ("FendLand," "we," "us," or "our") is a privacy management service designed to help landowners identify, document, and remove their contact information from unsolicited outreach databases. These Terms of Service ("Terms") govern your access to and use of fendland.com and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use FendLand. By using the Service, you represent and warrant that you meet these requirements.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@fendland.com if you suspect unauthorized access.

4. Message Scanner

The Message Scanner analyzes text you submit to classify the likely sender and suggest responses. By submitting a message, you confirm that:

• The message was sent to you and you have the right to submit it for analysis.
• You are not submitting content that violates any applicable law.

Scanner results are based on automated pattern matching and are provided for informational purposes only. They do not constitute legal advice. Classifications may be inaccurate.

FendLand scan results (including iOS SMS filter verdicts) may not be used for employment screening, tenant screening, credit decisions, insurance underwriting, or any purpose regulated by the Fair Credit Reporting Act (FCRA). FendLand is a personal privacy tool for individual property owners and is not a consumer reporting agency. Scan results represent FendLand's automated classification of unsolicited outreach patterns and do not constitute a consumer report.

4B. iOS SMS Filter

The FendLand iOS app includes an SMS filter extension that classifies incoming text messages from unknown senders. When enabled:

• iOS sends the content of SMS/MMS messages from unknown senders to FendLand for classification.
• FendLand determines whether the message is unsolicited real estate solicitation and instructs iOS to route it to Junk or allow it through.
• Messages classified as non-property-related on your device are never sent to FendLand's servers.
• FendLand does not store message body content from the SMS filter. Only a hashed phone number, verdict, and timestamp are retained.
• The filter only processes SMS and MMS from unknown numbers. It does not access iMessages, messages from your contacts, or any other data on your device.

The SMS filter can be disabled at any time in iOS Settings. FendLand is not responsible for messages incorrectly classified. The filter defaults to allowing messages through when uncertain.

5. Authorized Agent — Data Removal Requests

For Assisted and Hybrid removal targets, FendLand sends suppression and do-not-contact requests to third-party data brokers and platforms on your behalf. By initiating an Assisted or Hybrid removal request, you:

• Expressly authorize FendLand to act as your authorized agent for the purpose of submitting that specific removal or suppression request.
• Confirm that the personal information you provide (name, phone number, state, email) is accurate and belongs to you.
• Understand that FendLand transmits your request but cannot guarantee that the recipient will honor it or permanently remove your data.
• Acknowledge that some platforms may require you to complete additional verification steps directly.

This authorization is limited to the specific removal request you initiate and does not grant FendLand any broader authority to act on your behalf.

6. No Guarantee of Removal

FendLand submits removal requests in good faith but cannot guarantee that any data broker, people-search site, or wholesale platform will honor the request, remove your data permanently, or prevent your data from reappearing. Data removal results vary by platform and may take 30–90 days. This is not a legal service.

7. Community Blocklist

When you scan a message classified as WHOLESALER or SCAM and a phone number is provided, FendLand may anonymously contribute that number and classification to a shared community database ("Community Blocklist"). No personally identifiable information about you is associated with this contribution. The Community Blocklist is used to surface aggregate reputation data to other FendLand users.

8. Acceptable Use

You agree not to:

• Use the Service to submit false or fraudulent removal requests.
• Attempt to reverse-engineer, scrape, or abuse the Service or its APIs.
• Use the Service for any purpose that violates applicable law.
• Submit content you do not have the right to submit.

9. Intellectual Property

The Service, including its design, code, and content, is owned by FendLand and protected by applicable intellectual property laws. You retain ownership of any content you submit (messages, notes, personal information). You grant FendLand a limited license to use that content solely to provide the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FENDLAND DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FENDLAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. FENDLAND'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account at any time by contacting support@fendland.com.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use after changes take effect constitutes acceptance.
